Terms and conditions for using SiteIQ.

Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of SiteIQ ("Service," "we," "our," or "us"). By accessing or using SiteIQ, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Eligibility

You must be at least 18 years old and able to form a binding contract to use SiteIQ. By using the Service, you represent and warrant that you meet these requirements.

Account Registration

Creating an Account

To use SiteIQ, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

Account Restrictions

You may not:

  • Share your account with others
  • Create multiple accounts to circumvent limitations
  • Use automated tools to create accounts
  • Impersonate another person or entity

Description of Service

SiteIQ provides AI-powered website monitoring and analysis services, including:

  • Automated website scanning and performance analysis
  • AI-generated insights and recommendations
  • Chat-based interaction with your site data
  • Fix generation for common website issues
  • Scheduled monitoring and email digests

What We Analyze

By adding a site to SiteIQ, you authorize us to:

  • Access and fetch your site's public pages
  • Run performance tests via Google PageSpeed API
  • Analyze your site's HTML, metadata, and content with AI
  • Store snapshots and analysis results
  • Re-scan your site according to your chosen frequency

Service Limitations

SiteIQ is designed for monitoring a single public website. We do not support:

  • Sites behind authentication or paywalls
  • Sites that block automated crawlers
  • Private networks or intranets
  • Illegal, malicious, or adult content sites

Subscription Plans and Billing

Free Plan

The free plan includes:

  • One site
  • Weekly scans
  • Limited chat interactions
  • Read-only access to findings

Paid Plans

Paid subscriptions provide additional features as described on our pricing page. By subscribing, you agree to:

  • Pay the subscription fee for your chosen plan
  • Recurring monthly billing until cancellation
  • Automatic renewal unless cancelled
  • Potential price changes with 30 days' notice

Payment Terms

All payments are processed securely through Stripe. You authorize us to charge your payment method on a recurring basis. If payment fails:

  • We will attempt to retry payment
  • Your subscription may be suspended after multiple failures
  • You remain responsible for unpaid amounts

Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • You retain access until the end of your billing period
  • You will not be charged for subsequent periods
  • No refunds are provided for partial months
  • Your account reverts to the free plan

Refund Policy: We offer refunds only in cases of billing errors or service failures. Contact support within 7 days for refund requests.

Acceptable Use

You May Not:

  • Use SiteIQ to monitor sites you do not own or have permission to analyze
  • Attempt to reverse engineer, decompile, or extract our AI prompts or algorithms
  • Overload or interfere with our infrastructure (rate limiting, excessive requests)
  • Use the Service for any illegal purpose or in violation of any laws
  • Transmit viruses, malware, or malicious code
  • Scrape, data mine, or harvest information from the Service
  • Share, resell, or redistribute the Service without authorization
  • Use the Service to harass, abuse, or harm others

Site Ownership

By adding a site to SiteIQ, you represent and warrant that:

  • You own the site or have explicit permission to monitor it
  • The site is publicly accessible
  • The site does not violate any laws or third-party rights

Intellectual Property

Our Rights

SiteIQ and all related trademarks, logos, and service marks are owned by us. The Service, including its design, functionality, code, and AI models, is protected by copyright, trademark, and other laws.

Your Content

You retain ownership of your website content. By using SiteIQ, you grant us a limited, non-exclusive license to:

  • Access and analyze your site's public content
  • Store scan results and findings
  • Use your business description to improve AI analysis
  • Improve our AI models using aggregated, anonymized data

We will not share your specific site content with third parties except as necessary to provide the Service (e.g., sending to Anthropic for AI analysis).

Generated Fixes

AI-generated fixes and recommendations provided by SiteIQ are licensed to you for use on your website. You are responsible for reviewing and testing any generated code before implementing it.

Disclaimers and Limitations

No Warranty

SiteIQ is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Accuracy or completeness of analysis
  • Availability or uptime
  • Freedom from errors or bugs
  • Security or data integrity
  • Fitness for a particular purpose

AI Limitations

Our AI analysis is powered by Anthropic Claude models. AI-generated insights and fixes:

  • May contain errors or inaccuracies
  • Should not be considered professional advice
  • Must be reviewed and validated before implementation
  • Do not guarantee improved website performance or conversions

Limitation of Liability

To the maximum extent permitted by law, SiteIQ and its affiliates will not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from use or inability to use the Service
  • Damages caused by third-party services (Anthropic, Google, Stripe, etc.)
  • Damages from implementing AI-generated fixes or recommendations

Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us in the 12 months before the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless SiteIQ and its affiliates from any claims, damages, losses, or expenses (including attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your site content
  • Your violation of any laws or third-party rights

Data and Privacy

Our collection and use of your information is governed by our Privacy Policy. By using SiteIQ, you agree to our data practices as described in the Privacy Policy.

Service Modifications and Termination

Changes to the Service

We reserve the right to:

  • Modify, suspend, or discontinue any feature
  • Change pricing with 30 days' notice
  • Impose new limits on features
  • Update these Terms

Termination by You

You may terminate your account at any time through account settings. Upon termination, your data will be deleted according to our retention policy.

Termination by Us

We may suspend or terminate your account immediately if:

  • You violate these Terms
  • Your payment fails repeatedly
  • You engage in abusive or fraudulent behavior
  • Required by law
  • We discontinue the Service

We will provide notice when reasonably possible, but reserve the right to terminate immediately for serious violations.

Dispute Resolution

Informal Resolution

Before filing a claim, you agree to contact us at support@siteiq.app to attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If informal resolution fails, disputes will be resolved by binding arbitration under the American Arbitration Association (AAA) rules, rather than in court. The arbitration will be conducted in [Your Location], and each party will bear its own costs.

Exceptions: You may bring claims in small claims court if they qualify. Either party may seek injunctive relief in court for intellectual property infringement.

Class Action Waiver

You agree to resolve disputes individually. You waive the right to participate in class actions, class arbitrations, or representative actions.

General Terms

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and SiteIQ.

Governing Law

These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles.

Severability

If any provision is found unenforceable, the remaining provisions will remain in effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment

Force Majeure

We are not liable for failures or delays due to circumstances beyond our reasonable control (natural disasters, war, pandemics, internet outages, third-party service failures, etc.).

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last updated" date
  • Notify you via email or in-app notification
  • Provide at least 30 days' notice before changes take effect

Your continued use of SiteIQ after changes take effect constitutes acceptance of the new Terms. If you do not agree, you must stop using the Service and cancel your account.
